His proposed order would violate an overwhelming legal consensus dating back many decades that the Constitution grants citizenship to persons born in the United States regardless of their parents' immigration status. The 14th Amendment, it declared, "has conferred no authority upon Congress to restrict the effect of birth, declared by the Constitution to constitute a sufficient and complete right to citizenship" (emphasis added).

This is further confirmed by the fact the Native Americans born within the physical confines of the United States were not considered birthright citizens because it was considered that they were under the jurisdiction of their tribe and it's laws and not those of the United States.

The 14th Amendment, which grants citizenship to anyone born on US soil, was ratified in 1868 after the Civil War so that recently-freed slaves could become citizens.

The most recent amendment to the U.S. Constitution was ratified in 1992, some 202 years after it was proposed by the first Congress.

Also, the 14th Amendment confers citizenship on those born in the USA and "subject to the jurisdiction thereof". It later was used to guarantee citizenship to all babies born on USA soil after court challenges.

Former Sen. Jacob Howard (R-Michigan), author of the citizenship clause of the 14th Amendment, said on the floor of the Senate in 1866 that the clause "will not, of course, include persons in the United States who are foreigners, aliens, who belong to the families of ambassadors or foreign ministers accredited to the Government of the United States, but will include every other class of persons".

The Dred Scott decision by the U.S. Supreme Court (1857) declared that the descendants of enslaved Africans were NOT citizens of the USA.

Nor is this a small matter. In these frightening times, we need an analysis and a strategy centered on building solidarity with the most targeted communities while placing an urgent emphasis on direct action and mobilization.

Yet that 250,000 is a drop in the bucket compared to the total number of immigrants now coming.

The troops will bolster the existing National Guard and Customs and Border Patrol presence at the border, as a thousands-strong "caravan" of Central American migrants makes its way towards the USA through Mexico. When the dust settles several months from now, we may well find that it's all much ado about nothing.
